Information: Experience with Itanhandu

This page is to serve as personal testimony. We hope to help others form their purchasing decisions by having more information than we had. We have since learned that others have received poor quality Filas and pedigree difficulties from Itanhandu. Had we been aware of the problems others have had with Itanhandu we would have taken our business elsewhere.

We made two show quality purchases, male and female. The purchase price was $1,300.00 each, including shipping per dog. The agreed $2,600.00, turned into a $ 3,519.00 total cost. This includes multiple additional freight charges that hadn’t been paid by Cintia and Gerson. We have neither the quality animals nor the pedigrees, while they have taken all of our money.

We found out too late the racketeers that Cintia and Gerson have shown themselves to be. Our phone calls to their residence began with many people who were available to speak English; then degenerated in the end to “no speak English”! Cintia went from being sweet on the phone to being rude. E-mails went from being responded to in a timely manner in the beginning to being ignored for weeks up on weeks. They went from honoring the PennHIP examination to deciding they wouldn’t.

We tried to accommodate Cintia and Gerson in any way we could think of including:

  • offering to accept only one show quality dog in replacement of the two already paid for
  • offering to accept the return of the additional cost of shipping that we had paid to consider the contract fulfilled
  • offering to accept only the purchase price of the male returned and consider our contract fulfilled.

When our efforts were responded to by e-mail that we would have to continue paying shipping for additional replacement dogs, and our phone calls responded to with “no speak English”, we pursued legal action. The law firm we consulted reviewed our situation and advised us we have cause for legal action. They also pointed out that after paying for services, the likely result will be that the court order Itanhandu to provide us with two dogs. The result… right back where we started.

Below are chronological copies of the majority of the e-mail communications we had with Cintia and Gerson. You may review them and decide for yourself if you should or should not be involved in any transaction with Cintia and Gerson owners of Inthandu Kennel. Please refer to “Our Kennel” page to see the individual animals, their hip exams and the photographs. These were all provided as attachments in the following e-mails.

In an effort to maintain as true a representation of the conversations, I won’t be translating the transmissions from their original English form into Portuguese or Spanish. I’m sorry for the lack.

Hello,

I am not sure if you remember communication we started a few months ago. I am very interested in purchasing two Filas. My husband and I will be traveling to South America for the first three weeks on October 2007. Our last stop will be in Brazil before we head home to Sacramento, California, USA. Are
you still interested in selling one of your puppies, and will you be in a position with your breeding program to have quality puppies then?

If you have any questions, feel fre to ask. I am looking forward to hearing from you.

My name is Dianna. We wrote to each other before. I would like to find out when your next litter is planned. Who will you be breeding? My husband and I would like to buy one. In addition, we would like to make arrangements in the future to buy a second when we are in Brazil in October 2007.

We have seen one of your females in California owned by Alex B. and her type is exactly what we want.

How much for the purchase, shipping fees, documentation?

Gerson,

I look forward to pictures of the parents and puppies.

I have one female, 3 years old, I have taken to multi championship. Her pictures are attached for your pleasure. This year she has developed either bad genetic hip trouble or a soft tissue “sport” injury from jumping. I haven’t taken her to the vetrinary to be diagnosed yet. I won’t be able to breed her if the vet
says it is genetic.

A female would be the best choice due to time taken to reach maturity. Do you want any history information from me? My first goal is to protect our family, for our second goal we spend our time
training, showing, and traveling with the dogs alongside. Since 1997 it has been for fun, I hope to find dogs worthy to breed someday.

I don’t know if you know the showing groups in the USA. In order to begin immediate showing I would need at least copies of the parent’s pedigrees to put a pending registry with IABCA, UKC, ARBA,
and Rarities in the United States to show. I know from past purchases how long pedigree documents can take to get. I have dealt only with Brasil paperwork once. The rest has come from Puerto Rico in the form of FCI paperwork. Here in the USA, with the correct documents they will “hold” points won until
formal documentation is received. This is the difficulty I ran into with Sierra’s puppy.

How do you prefer funds to be transferred? When would shipping to Sacramento California be?

Regarding October 2007, we would want to purchase a male at that time. For future use, he would need to be of different lineage, but sleek in type like your females. Is that possible?

Thank you for writing back so soon. I tried the phone number on the web site but the language barrierI look forward to talking.

Gerson,

We
are definately interested in her. The fax number for the
pedigrees to be sent to is 916-746-7032. Quiara looks to have
an extremely powerful and thick neck and chest. Is it just the
angle of the picture? Super SDI, the make is athletic and
beautiful. What other pictures can you send of the
parents?

With
the receipt of the faxes, we will be in position to go to the bank
for the wire. What is the puppy’s registered name? What
should be the actual shipping day? Are you able to reach
Sacramento, California, or should I plan traveling to another
airport?

For
your information, the puppy will begin with show training
immediately. Mid December has a show we will aim for.
Also, I attached pictures of my two daughters who also participate in
showing. We have a 4 year old Basenji also. My youngest
is looking forward to showing the puppy until it reaches a size
where she might not be able to control it adequately.

I
know I saw mention of Urano’s name when I was looking around on the
web, but can’t remember the site.

I
look forward to communicating with you again.

There

They
will do the standard all over check, fecal check,

and
Parvo test. I will forward the information.

Saturday
the 9th will be her first show. Just a first

step
to get her used to the scene. If you like, I

will
likewise forward photos and results. Some past

breeders
have wanted them. She will have an I.A.B.C.A.

show
January 17th, 2007, in Santa Rosa, an another

Rarities
whow January 27th, 2007, in Anaheim, then not

until
April 7th, 2007, another Rarities show in

Anaheim,
both cities are here in California. She will

be
showing both in the standard “conformation” ring as

well
as the “Junior Handler” ring with my daughter.

What
is the itinerary for shipping? Times of

departure,
flight numbers, times of arrival? We will

be
taking the day off work to receive her! Will you

be
giving her a sedative to calm her, or let her

handle
it on her own? When her pedigree comes in,

will
it mail directly to me to to you first then me?

More
pictures of the parents or Sonja would be

appreciated
for her book. I keep a binder with all

pictures
and documentation on each dog for future use.

Best
wishes to you and your family.

Gerson,

Happy New Year to you and your family. All is very well with us. I waited to write until I had enough interesting information to send along. I’ve tried to write including all eleven images but the system won’t accept it. I will follow this e-mail with just attachments for your pleasure. When Sanja came she was solid and not afraid. Her vet check was perfectly clear. She weighed 20.1 lbs. at 8 weeks. Her

first two shows, 12/09/06, were in Davis. She was the only Fila. She received two Best of Breed (of

course), then she did receive two Best of Groups (better) but no placement when in for Best of Show.

She was mostly confident.

We’ve battled soft stools until last week, trying different dog foods. Finally feeding lamb and rice has given her solid stools.

Her last show 01/14 and 15 was in Santa Rosa. She had four shows. She was the only Fila but there was a lot of breeds competing. She received all four Best of Breeds (of course). She received two Best of Group (13 other breeds varying in age up to a year old)!

Then guess what!? She received reserve Best of Show (second place)! She handled very well. I will be forwarding her certificates and a copy of her award medals for you to look at.

Her last vet check was last Monday. She weighs 40.2 lbs.

She is smart, beautiful and very loving. I see much potential in her.

Our upcoming show schedule will be increasing. March has one weekend of shows. April has three weekends of shows. May has three different shows, including the World Dog Show in Mexico City, Mexico. My daughter and I will be going with Sanja. We will show her in corformation as well as Junior Handler.

Do you have any suggestions on when paperwork might arrive? Will it come to your address first or mail here?

We have firmed up our trip to South America with our jobs and are starting to plan specifics. You had mentioned you might be able to assist us, is that offer still there?

I hope all is well with you and yours, and look forward to hearing from you.

Hi Gerson,

I will resend the e-mails I sent in January. They included pictures. Sonja received Reserve Best In Show for puppys. She competed against about 18 other working dog breeds. She was the youngest at 12 weeks old, the others were anywhere from 6 to 18 months old. She was the only Fila but she outshone the others in group as well show.

We took both Chica and Sanja in to get their PennHip hip certification done the Monday before last. It turns out that Chica’s (my other Fila) hips are not the problem I thought. She has a severe sports injury, she blew out both of her ‘crusix’ (I might be spelling that wrong) tendons in both her knees. While I don’t have the actual numbers from the x-rays yet, the vet says her hips are not only good but, “are what a
breeding program could be based on.” That makes me happy in one way. I am going to attempt to breed her in her August heat cycle. That is why Trevor and I are hoping to find a male now. It would be best if the puppy’s parents were as high up on the scale for hip screening as possible. Do you have any good
candidates for a male puppy now or in the next two months?

He did say that Sonja’s hips were noticeably looser than Chica’s but didn’t say there was worry.

We will be postponing our three week trip until 2008.

When should I expect to receive Sonja’s paperwork?

I hope all is well with you and your family.

Sincerely,

Dianna

Gerson,

Happy
New Year to you and your family. All is very

well
with us. I waited to write until I had enough

interesting
information to send along. I’ve tried to

write
including all eleven images but the system won’t

accept
it. I will follow this e-mail with just

attachments
for your pleasure. When Sanja came she

was
solid and not afraid. Her vet check was perfectly

clear.
She weighed 20.1 lbs. at 8 weeks.

Her
first two shows, 12/09/06, were in Davis. She was

the
only Fila. She received two Best of Breed (of

course),
then she did receive two Best of Groups

(better)
but no placement when in for Best of Show.

She
was mostly confident.

We’ve
battled soft stools until last week, trying

different
dog foods. Finally feeding lamb and rice

has
given her solid stools.

Her
last show 01/14 and 15 was in Santa Rosa. She had

four
shows. She was the only Fila but there was a lot

of
breeds competing. She received all four Best of

Breeds
(of course). She received two Best of Group

(13
other breeds varying in age up to a year old)!

Then
guess what!? She received reserve Best of Show

(second
place)! She handled very well. I will be

forwarding
her certificates and a copy of her award

medals
for you to look at.

Her
last vet check was last Monday. She weighs 40.2

lbs.

She
is smart, beautiful and very loving. I see much

potential
in her.

Our
upcoming show schedule will be increasing. March

has
one weekend of shows. April has three weekends of

shows.
May has three different shows, including the

World
Dog Show in Mexico City, Mexico. My daughter

and
I will be going with Sanja. We will show her in

corformation
as well as Junior Handler.

Do
you have any suggestions on when paperwork might

arrive?
Will it come to your address first or mail

here?

We
have firmed up our trip to South America with our

jobs
and are starting to plan specifics. You had

mentioned
you might be able to assist us, is that

offer
still there?

I
hope all is well with you and yours, and look

forward
to hearing from you.

Hi
Dianne

Thanks
for the photos. i like very much her bones structure. She will be
like her mother, very strong. He have a lot to grew and be a great
adult for sure.

In
january we was on the beach and our e-mail box was probably full,
that could be the reason I didn’t got them.

I
have a new litter Fiança x Embu, they are excelent dogs.
Fiança is one of my bests females in HD, her score is 115, its
xexcelent. And Embu is also very good, 110. I think one male from
thsi breeding will be excelent. Puppies are still 30 days and I can
choose the best male of the litter for you. The mother of Embu is
CAFIB champion. Both dogs top of cafib bloodline.

I
have other litters now, but if you culd wait a litle(one
month) , this litter will be excelent for you.I can keep sending
photos everyweek for you if you want and choose the best male!

I’m
up dating my webiste and doing a page with dogs on shows, can I
put a photo of Sanja and your name like the owner there?

Gerson,

The
photos, sure. Whatever I send to you for photos,

medical
documentation or written paperwork you may

use.
If there is something that is private between

the
two of us I will clearly state it, thank you for

asking,
I appreciate it.

A
wait for a month is just fine. I am trusting your

judgement.
Are there photo’s of Fianca amd Embu? Are

there
pictures of there parents?

Sonja
is strong boned. Her front legs sometimes splay

out
at the wrists. I am feeding her raised up as high

as
she can stand straight. I find this promotes a

straight
front line. Her rear end is still good and

strong…not
cow hocked, not pigeon toed.

Her
face is so sleak it takes my breath sometimes. It

is
constantly changing but the four different judges

appreciated
her smooth transition from muzzle to

cranium.

Her
pain tolerance is high. Shots have been nothing

to
her. The sedative for the x-ray did get a yelp,

but
that is all.

She
is smart…I mean it. I’ve had a lot of dogs and

she
is smart. So smart I have enlisted her in a

formal
obedience class starting March 15. She is

stable
in her confidence, not overly shy. She is

brave,
barking at strange things and not running away.

She is
barking for good reason, not just because.

I
take her with me to as many places as possible. She

does
well.

Any
pictures or documentation you can forward on the

upcoming
male pup would be appreciated.

Thank
you, this week I will put photos of her!

I
will take pictures of the puppy to send you. There are two males that
I’m

liking
a lot, so i will be looking and choose the best for you.

His
parents are Fiança her mother and father were champions in
cafib. The

father
of the puppy is Embu and his mother was also champion by cafib and

father
was the best brindle male of cafib( I’m sending a video of him). I

Hi
Gerson,

In
the states it seems harder to please the judges with a brindle coat,
they say they can’t distinguish muscle tone and body lines as
easily. While health and a stable mind are the most important
aspects to me, a fawn coat would be our preference. If that is
not possible, then a sound brindle coat would do.

When
were the puppies born? When will they be ready to ship?
Are you able to send me the hip certifications for the parents?
For that matter, would you be able to send a copy of Sanja’s parents’
health certifications?

Hi
Dianna

I
agree with you, the brindle color is very dificult to judge. The
father of Embu was the best brindle male CAFIB ever had, it was very
dificult a brindle like him and Embu is going to his way, its a great
male. Out of this litter I have two fawns males that are very nice,
strong and with some caracteristics that I’m liking a lot. I will be
looking for the best for you and will send pictures soon.

I’m

Hi
Dianna

The
bite of Xaua is normal for his age.Xaua bite will be perfect when he

change
the teeth, I garantee you. I’m dentist, specialized in ortodontics.

Its
very comun filas have a litle more space in this age between the
upper

teeth
and the lower teeth. And its good, when he change the teeth, he will

have
a “Scissors bite”. It means that the lower incisors close
just scraping

the
inner surface of the upper incisors.

The oposite
of his bite we call prognatism and its disqualify.

Hello
Cintia,

The
three Filas I’ve had, Chica, Ipo and Sanja, I’ve

had
from 8 weeks old. Their bone structure definately

shifts
and change as they grow. But none have had a

pronounced
space like Xaua’s. He’s 10 1/2 weeks old.

You
are much more experienced in this matter. I’m

willing
to trust your recommendation for another

month.
By the middle of next month he will be loosing

his
teeth and growing like a weed. If it is better,

GREAT!
If not, we’ll need to consider exchanging him.

I love his
head.

I
won’t be able to show him with his bite like it is

now.
They would rate him Mangelhauf and not allow him

to
ever show again.

I
will call this evening to speak about Sanja’s hips.

I
know this distance can seem inconvenient, I’m sorry

for
that. We really love showing though and want

healthy
beautiful Filas. It must be difficult

deciding

I

I’ve

many
questions to answer.

How
much have they been exposed to children?

How
much are they socially interactive with other

dogs?
Are they dog aggressive?

Do
they have any leash and obedience training?

Have
they been shown? Did they earn any championships

yet?

Has
the dog been bred yet? Did it produce?

How
do I go about incorporating a full grown Fila into

our

Would
you be able to provide front, rear and both side

I

My

We

Bonding,

We

Cintia

What OFA rating do they have?

Sanja
has an appointment for the 18th of May to get

She has 4 more obedience classes to go to. I

might

Xaua

No

Hello

She was vet checked last night and all seems

The stool sample will take two days but I am

it is fine. Her first show is on the 23rd of

this
month in Dixon.

I’ve
included a home shot with her and one with her

and
Xaua!

I’ve
scheduled her PennHIPP in three weeks.

Customs
in Houston removed every shred of

documentation,
including the usual health record with

shot
labels you have sent before. When were Coxia’s

shots
and were they the same as Sanja and Xaua?

I
had to pay an additional $ 130.00 in fees for

customs
and shipping. With the $ 400.00 that I wired

to
you, that makes a total of $ 530.00. I questioned

Continental

Cintia
e Gerson,

I
need to explain why I had questioned the billing

when
Coxia came. Attached is the airbill you

requested.
In the bottom left, circled is the “Total

Prepaid
477,00”. Continental Airlines stated this was

printed
in Brazilian reais and that this was your

amount
paid – equalling U.S. dollars $ 239.00. After

reading
more closely and researching, it appears that

this
$ 477.00 is instead U.S. dollars and the furthest

bottom
left amount of 938,74 was the Brazilian reais

amount.
I apologize for questioning, but they gave me

the
wrong information. When they asked for the

additional
$ 130.00 to pick her up, I only wanted to

understand
why I was paying additional fees when I

hadn’t
paid them before.

I
took Coxia to get her hips checked last Friday. I

won’t
have the actual measurement certificate for

another
6 weeks or so. Unfortunately the vetrinarian

is
the hip expert at the facility and said Coxia’s

hips
look like Sanja’s did and will undoubtedly

develop
HD. I will wait to see the final report but

it
looks as though she will have bad hips also. In

that
case we need to talk about options.

Xaua’s
bite is still 3/8″ inch off. I am feeling

desperate
with the difficulties. I am considering

getting
his hips checked anyway even if his bite is

bad.
With his bite the way it is I will never be able

to
show him. If I check his hips and they turn out

good,
mated with Chica’s good hips, I have a better

chance
at hip healthy puppies. Chica has a correct

bite,
so if Xaua has healthy hips and I breed them, I

might
get some puppies with even bites. I would have

to
immediately fix all the puppies with incorrect

bites
and sell them as pets only.

Do
you have any suggestions? If Coxia’s hips are bad

like
the vetrinarian thinks, would you insist on

replacing
with a third female or would you consider a

refund
of the purchase price? If Xaua’s bite doesn’t

change
what do you want to do?

I
hope all is well with you and the family.

About
the x-rays my vet told that is better we have OFA. Pen hip is only a

prevision
and its uncertally. Because on OFA you have 5 scores A, B, C, D

and
E. If your dog have A, B or C its ok for breeding. The puppy is still
3

months
old and impossible say about dispalsy in this age as the complet

struct
is not formed yet. All dogs you x-ray in pen hip have problems,

starting
with XICA… Also pen hip have no studies with the fila brasileiro

Hi
Cintia,

Attached
is the copy of the remaining $ 130.00 paid.

It
is also noted at the bottom of the air bill, hand

written
to the right of the $ 477.00.

As
of two Fridays ago Coxia was 16 weeks old (4

months).

Chica’s
results were very good actually. While

.30/.30
would be the goal, I think .41/.43 is good for

a
program foundation built on health.

I
wish the international translations of books and

imperical
information kept up with the times. If you

and/or
you vetrinarian ever have the opportunity to

read
complete disertations of the University of

Pennsylvania’s
PennHIP program, you will discover

much.

PennHIP
knows all dog breeds by their bones. It’s

percentile
portion refers to specific breeds which has

a
growing Fila pool. It is has medically and

scientifically
proven itself in acurately showing the

predisposition
of puppies to get Displaysia from their

bone
placement measurement.

Implemented
in 1966, OFA is a subjective human looking

at
a single view on x-ray and assigning a grade to

man’s
measurements. Similar to a judge assigning a

“grade”
in a show ring. Of course the human looking

at
the x-ray has experience just like the judge in the

show
ring. The measurements via this method are a

minimum
of .31 statistically different between 4

months
and 24 months.

Began
in 1983 and implemented in 1993 PennHIP takes

accurate
and precise measurements of multiple views

and
mathmatically calculates them. These numbers are

then
inserted into a mathmatical database and produce

a
laxity value. These are not preliminary findings

they
have a mere .05 statistically different

measurement
between 4 months and 24 months. That’s

amazing
little especially compared to OFA.

The
different lies in the proven accuracy rate for

diagnosing
displastic dogs. Here in the US the trend

in
breeders is shifting away from OFA and turning to

PennHIP
because of this.

All
of this information aside, you have been clear.

While
you accepted to replace Sanja with Coxia, you

wish
now to wait until Coxia is two and I provide her

OFA
rating. We’ll speak of her at that time.

As
of today Xaua has one canine visibly being replaced

with
a permanent one, the other three are baby teeth.

The
measurement this morning was 3/8 inch. He will be

24
weeks old tomorrow (6 months).

I
hope all is well with you and the family.

Hello
Cintia e Gerson,

Xaua
has lost all his baby teeth. He has a 3/8″

overbite.
It has remained the exact same overbite

since
the day you sent him.

Today
I took him to the veterinarian and he has

informed
me that in addition to permanent incorrect

conformation,
the bottom canines will need to be filed

down
because they will puncture his palate.

With
what has transpired I would like to request the

original
purchase price of Xaua returned ($ 1,300.00).

He was
received in a visibly unacceptable condition

which
you have guaranteed against. I notified you

immediately
and agreed to wait at your request, just

in
case he miraculously changed. Costs incurred for

health
screening, shipping, daily care have brought me

to
make this request.

Secondly,
I need to know if you want him shipped back

to
you, or if you would prefer me to have him

neutered,
fix his teeth and find a suitable home for

him
here in the states?

On
another note, congratulations on the awards your

animals
received at their show.

Hi
Cintia e Gerson,

You
and I have dealt honestly with the contract you

outline
on your website, and I wish to continue doing

so.
I’m afraid that Prognatism isn’t a condition you

have
stated in your contract for a replacement puppy.

You
have stated under Hip and Elbow Displasia and

Internal
Health that you offer a replacement. For a

Temperment
and Prognatism you do not specify that.

With
bad hips, the defect is invisible and you should

have
no prior knowledge of the malady, thus a

replacement
in “good faith” might be acceptable. Just

as
we are dealing with Sanja and Coxia.

With
Xaua’s large undershot, the condition was visible

before
you shipped him, a demonstration against your

contract
claim of correct bite; he was sent in “bad

faith”.
I have incurred cost of care and vetrinary

fees.
I have missed the buisness opportunity to breed

my
adult female in season. In addition, since you

choose
not to take him back, I have incurred the fees

of
neutering him and placing him in a home. In

contractual
conflicts I’ve seen, these fees would be

reasonable
to ask for restitution. I am not asking

for
these additional costs.

In
this instance, I am sure anyone would agree in my

reasonable
request. I do not want a replacement,

instead
the $ 1,300.00 returned.

Sincerely,

Dianna
e Trevor

Cintia,

Please
forward Sanja’s, Xaua’s and Coxia’s

registration
papers.

Attached
is the photo requested. This is the same

sent
on August 4th of his permanent teeth. In

addition,
I can get a letter of authenticity from my

veterinarian.

Please
forward copies of the pedigrees and hip x-rays

for
both parents in the breeding pair you are

suggesting
a replacement puppy from. My veterinarian

has
examined the archives of the screening system you

utilize
and a rating of 115 or higher is what is

acceptable.
If you have the technology, my

Vetrinarian
hip specialist requests a DVD or CD image,

if
not I understand and would like to see at least the

images
you have produced in the past.

The
replacement puppy shipping cost is your

responsibility.
You and Gerson sent me a visibly

mongaloid
dog, you knew before you put him on a plane

that
his bite was incorrect. As such your legal

interpretation
of the contract does not apply to me

paying
for Xaua’s replacement. I paid for a specimen

free
of defects.

Please
do not delay in responding.

Dianna

They

health

within
five days of receipt of this dog. If there are

any
problems the dog must be returned immediately for

replacement.

Temperament
Guarantee All dogs leaving Serra de

Kennel are guaranteed to have correct fila

Hip
and / or Elbow Dysplaia Guarantee With 24

months
you must do a Rx of your dog and get a

veterinarium
certificate. If he have this problem the

buyer
must send a copy of the x-ray and OFA report to

Serra
de Itanhandu Kennel with the number of the

microchip
at the x-ray before the replacement is made.

The
buyer must return the dog.

Prognatism
Serra de Itanhandu Kennel give

garantees
also in the correct bite.”

Prognatism
isn’t a condition they stated for a

replacement
puppy.

They
stated specifically under “Hip and/or Elbow

Displasia”
and “Internal Health” the offer of a

replacement.
For a “Temperment Guarantee” and

“Prognatism”
they noticeably do not specify that.

With
bad hips, the defect is invisible and you should

have
no prior knowledge of the malady, thus a

replacement
in “good faith” might be acceptable.

With
Xaua’s large undershot, the condition was visible

before
they shipped him, a demonstration against

their
contract claim of correct bite; he was sent in

“bad
faith”.

I
have incurred cost of care and veterinary fees. I

have
missed the buisness opportunity to breed my

adult
female in season. In addition, since they

choose
not to take him back, I have incurred the fees

of
neutering him and placing him in a home. In

contractual
conflicts I’ve seen, all these fees would

be
reasonable to ask for restitution. I am not asking

for
these additional costs. In this instance,
I

think
this is a reasonable request. I do not want a

replacement,
instead the

$
1,300.00 returned.

They
have not forwarded the pedigree for the 8 month

old
female I purchased from them either.

Of
course I have photos and all the e-mails.

What
is the likelyhood of winning such a long distance

effort?

Dear
Dianna,

XXXXXXXXXX.

I
have presented your case to my partners and we came to the
conclusion that

the
apparently simplest (and cheaper) way to solve the question would
be a

contact
with your opponent to be done by myself, in order to try to get a

settlement,
in which you could receive back the value paid for the dogs and

the
freight costs. The dogs should be brought back and the
business should

be
undone.

Anyway,
if I am not successful to get the friendly agreement, the only
thing

to
do will be to sue the dog’s sellers. Brazilian Court shall try
the case.

Unfortunately,
I have to inform that the proceedings in Brazil run very

slowly
and maybe the costs will be at last bigger than the values you
have

already
expended. There will be other practical difficulties due to the

exigency
of the Brazilian law:

1
– all the documents to be used as evidences shall be written in
Portuguese

or,
if they are written in English, shall be translated to Portuguese,
by a

Professional
Translator, legally authorized to issue official translations.

This
is also expensive;

2
– normally the presence of the plaintiff in all the hearings is
a

condition
for the procedure – we could solve this difficulty by receiving

special
powers to represent you in hearings. The document to be signed by

you
shall be issued, unfortunately In Portuguese (you should to sign

documents
giving us some powers to represent you in terms you cannot

understand
and it is not a comfortable situation either for you or for us…)

So,
I propose to try first the friendly solution and talk again about
the

other
solution (trial) in case I have no success with it.

If
you agree, we will charge you with pro labore fee of US$ 500,00
(five

hundred
dollars) to be paid cash.

Please
let me know your decision.

I
and my partners are at your disposition for any further
information or

clarification
that you eventually have.

Yours,
sincerely,

XXXXXXXX
